Terms of Service
The rules and conditions for using the ZakiBrain platform.

These Terms of Service (“Terms”) govern your access to and use of the ZakiBrain platform, including the BALLS assessment system and related services. By creating an account or using ZakiBrain, you agree to these Terms. If you do not agree, please do not use the platform.
1. Acceptance of Terms
By registering for or using ZakiBrain, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you use the platform on behalf of an institution, you represent that you have authority to bind that organization.
2. Description of Service
ZakiBrain provides digital assessment tools, reporting, and related educational materials for authorized professionals working with children. The platform is intended for qualified clinicians, educators, and researchers — not for direct use by minors without professional supervision.
3. Account Registration
To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of applicable professional ethics.
- Share account credentials or allow unauthorized persons to access assessment data.
- Reverse engineer, copy, or redistribute platform content, norms, or materials without permission.
- Upload false, misleading, or harmful content through the platform.
- Interfere with the security, integrity, or performance of the service.
5. Assessment Data & Professional Responsibilities
As a professional user, you are solely responsible for obtaining appropriate consent, administering assessments correctly, interpreting results, and complying with applicable laws and institutional policies regarding child data. ZakiBrain provides tools to support your practice — it does not replace professional judgment.
6. Intellectual Property
All content, software, assessment materials, norms, branding, and documentation on ZakiBrain are owned by ZakiBrain or its licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the platform for its intended professional purpose during your subscription or trial period.
7. Subscriptions, Trials & Payment
Paid plans, free trials, and institutional licenses are subject to the pricing and terms presented at the time of purchase. We may modify pricing with reasonable notice. Failure to pay applicable fees may result in suspension or termination of access.
8. Termination
You may cancel your account at any time. We may suspend or terminate access if you breach these Terms or if required by law. Upon termination, your right to use the platform ceases, subject to our data retention and export policies described in the Privacy Policy.
9. Disclaimers
ZakiBrain is provided “as is” and “as available.” We do not warrant that the platform will be uninterrupted or error-free. Assessment results should be interpreted by qualified professionals within their scope of practice. We do not guarantee specific clinical or educational outcomes.
10. Limitation of Liability
To the fullest extent permitted by law, ZakiBrain and its founders, affiliates, and partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the competent courts in Tel Aviv, Israel, unless mandatory law provides otherwise.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
